Artist/Buyer Agreement
The Artist, Claude Buckley, and the Buyer, agree as follows: The Artist agrees to create and/or sell to the Buyer the following work(s) of art. The Buyer agrees to pay the Artist for the Work. Title of the work will not pass to the Buyer until full payment is paid. In the event that the Buyer is in breach of contract, the Buyer is not entitled to the return of any money paid prior to the breach. The Artist reserves all rights of a copyright in the Work. The Work will be completed and ready for delivery on the agreed upon date. Both parties agree that this date is an estimate only. The Artist will use his best efforts to notify the Buyer of anticipated delay. The costs of shipment, travel, installation and framing, of the Work, shall be borne by the Buyer. In the event of the Artist's death or disability, prior to completion of the Work, his heirs will be entitled to keep any payments already paid, and the Buyer is entitled to receive the unfinished Work and any supporting materials pertinent to the Work. If the Work is complete at the time of death or disability, the Buyer is expected to make final payments to the Artist's heirs.
This document binds the parties, their heirs, and all their successors in interest.
This agreement is subject to Binding Arbitration pursuant to
SC Code sections 15-47-10 et seq. (1976), as amended.
